The City of Hamilton and the owner of 347 Parkside Drive in Waterdown reached a confidential settlement agreement, resulting in the cancellation of a potential public Ontario Land Tribunal hearing.
Hamilton City Council has decided to not release any of the terms or the amount of money involved. Ontario’s freedom of information laws permit municipalities to keep secret the terms and conditions of expropriation settlements.
The expropriation was required to facilitate the construction of the planned Waterdown bypass road, which will run through the centre of the property, north of Parkside Drive. The lands are within the Greenbelt, meaning they cannot be developed into urban uses.
Following the expropriation, the owners of the property, 2441066 Ontario Inc., sought higher compensation than the City’s initial offering.

In 2022, before Hamilton City Council voted to freeze the urban boundary, and also before the Ontario Progressive Conservative government reversed urban boundary expansions into the Greenbelt, the owners sought to have the southern remnant lands brought into the urban boundary. The other side of Parkside Drive is within the urban boundary area.
This publication learned that a settlement was finalized thanks to a nearby resident who contacted the Ontario Land Tribunal seeking an update on the matter following the postponement of a scheduled hearing in January.
In an email response, an OLT case coordinator wrote that “a settlement of compensation was reached.”
Work on the Waterdown bypass road is presently paused as the City of Hamilton negotiates with the Haudenosaunee Development Institute.
