The Ontario Land Tribunal has formally endorsed an agreement between the City of Hamilton and Highgate Holdings Inc. to permit the expansion of the Highgate Residence at 299, 307 and 325 Fiddler’s Green Road in Ancaster.

Ontario Land Tribunal Member Yasna Faghani issued the approval on November 10, nearly two months after the City and Highgate presented their settlement plan on September 15. While most settlements receive immediate approval, Faghani delayed her decision in this case.

The decision confirms significant changes from the original proposal:

Height and density: The approved project includes four storeys and 67 units, compared to the original application’s three storeys and 59 units.

Occupancy: Each new unit is restricted to single-occupancy.

Tree preservation, setbacks, and sidewalk: The settlement requires increased setbacks from the property line. The original proposal called for removing 35 of the 44 existing trees on the property; the new agreement mandates a two-to-one tree compensation rate and adds a sidewalk on Fiddler’s Green Road. The exact number of trees to be removed is not specified in the tribunal’s decision.

The settlement avoids a contested hearing. Highgate filed its non-decision appeal on October 21, 2024.
