OpinionJoey’s Notepad: Peterborough Has Two Integrity Commissioners – one for investigations, one for education/advice

I learned today that the City of Peterborough employs the services of two separate municipality integrity commissioners – one for investigations and one for education.

The outgoing Council has renewed the contracts of David Boghosian for investigations, and John Ewart for education.

a) That RFP-91-26, Integrity Commissioner Services be awarded to David
Boghosian of Boghosian & Allen LLP., 37 Spadina Road, Toronto, Ontario, M5R
2S9 for a contract term of four years ending December 31, 2030, to whom is
assigned the investigative, reporting and, as applicable, inquiry functions outlined
in clauses 223.3(1) 1, 2 and 3 of the Municipal Act, 2001, S.O. 2001, c. 25, with
an option in favour of the City to extend the agreement on the same terms and
conditions, for an additional term to a maximum of three, one-year extensions.

b) That Council extend the appointment of John Ewart of Ewart O’Dwyer as Integrity
Commissioner for a term expiring December 31, 2030, to whom is assigned the
advice-giving and educational functions outlined in clauses 223.3(1) 4, 5, 6 and 7
of the Municipal Act, 2001, S.O. 2001, c. 25, with an option in favour of the City
to extend the agreement on the same terms and conditions, for an additional
term to a maximum of three, one-year extensions.

I honestly did not consider this as a possibility under the Municipal Act.

This arrangement appears to be working, because I haven’t noted any controversies resulting from the dual roles.
