Only six new hearings are on the agenda for the October 22, 2024, Committee of Adjustment meeting.

Three reasons are contributing to the low number of applications: updates to Hamilton’s zoning bylaws to be permissive (combined with parking reductions), a decrease in development activity, and that the CoA is holding regular meetings.

There are two applications of obvious note in the agenda.

71 Rebecca Street – Parking Variances and Balconies

The City Council approved 30-storey, 477-residential unit tall building at 71 Rebecca Street is seeking a ~20 percent parking reduction.

The building is now planned to be 29-storeys, with one level of parking eliminated.

Developer Rosehaven Homes is seeking to build under the old parking standards that require 214 parking spaces. They are requesting a minor variance to permit 171 parking spaces. (Hamilton’s new parking bylaw – partially approved by the Ontario Land Tribunal -requires 26 parking spaces.)

Rosehaven is also seeking permission to have 1.5 metre deep balconies, the zoning bylaw only permits 1.0 metres.

City planning staff comments on the variances are expected around October 15.

1135 Stone Church Road East  – Church on Commerical Lands

This application is “to permit the use of a Place of Assembly whereas the zoning by-law does not permit this use in a C6-District Commercial zone.”

The New Apostolic Church wants to build a one-storey church.

The Church submits that a place of worship is similar to the intended larger store commercial zoning use “the assembly of persons in a large building is permitted on the subject lands”

They submit the change in use is minor.

City planning staff comments on the variances are expected around October 15.
