Hamilton’s Committee of Adjustment (CofA) has posted the official notice of decision denying the application for severance filed by Steelport for the former Stelco lands. Hundreds of people attended the June 4 CofA hearing to express their opposition to the severance because the land division would help facilitate an AI data centre. The CofA heard over six hours of public delegations in opposition. There was one delegation in favour.
Following the delegations, the Committee of Adjustment unanimously denied the application. “It meets all the regulations for that property,” stated CofA Member Robert Reid about the application. “But at the same token [sic], because of the residents, the way they came out today and voiced their opinions, I make a motion to deny the severance.” Reid was the only CofA member to speak to the application.
The official denial states the land severance conflicts with the Urban Hamilton Official Plan, contravenes Zoning By-law requirements, is not in keeping with development in the area, and is not necessary for the proper and orderly development of the lands.
The decision states Steelport has until “July 01, 2026 at 4:30pm” to file an appeal to the Ontario Land Tribunal. July 1 is a holiday. Ontario’s Interpretation Act extends the deadline to the next business day, meaning Steelport can file an appeal until July 2 at 4:30 p.m.
Next Tuesday, June 16, 2026, City Council’s Planning Committee will debate a motion to implement a one-year prohibition on any new or expanded data centres in Hamilton by implementing an interim control by-law.
