The first four days of a nine-day hearing at the Ontario Land Tribunal regarding a non-decision appeal by Losani Homes involving 1400 South Service Road were held last week.

Losani presented its evidence and experts during the week, with the City of Hamilton scheduled to make its arguments this week.

The hearing will conclude with written, rather than oral, closing arguments due to the complexities associated with the Ontario government’s numerous Planning Act and related regulatory changes over the past few years.

The critical point of disagreement is whether the lands should remain or even if they are properly designated as employment lands.

In addition to disagreement regarding the designation, the two sides disagree regarding if commercial uses are employment uses.

The City of Hamilton states that the lands must remain designated for industrial or warehousing use because they are one of the last greenfield properties along the major goods movement corridor of the Queen Elizabeth Parkway. The City opposes converting the lands to residential uses.

Eight hundred forty (840) residential units are proposed, down from the last publicly known submission of 986 units. Losani Homes plans 11,200 square metres of commercial use, which they estimate will host approximately 520 jobs.

The videoconference hearing will continue until Friday, May 2.
