Hamilton City Council and the owners of 509 Southcote Road (Carriage Gate Homes / “Southcote Hills Inc.”) have reached a settlement agreement regarding a Site Plan approval dispute. The details of the dispute are not known; the Ontario Land Tribunal does not provide public documents on its website.

In a procedural notice issued on July 30, 2026, the Tribunal has set a deadline of August 30, 2026, for the City and developer to file the settlement documents.

This case is a Site Plan appeal involving a proposal for 59 three-storey street townhouse dwellings arranged in 10 blocks fronting onto a private condominium road.

The City of Hamilton and the landowner reached a settlement agreement in an earlier Ontario Land Tribunal appeal regarding the zoning of the site. (OLT Case Number OLT-23-000673)

Following the January 2026 agreement, the developer and City could not agree to Site Plan conditions, and this appeal was filed with the OLT.

Separately, the developer has filed a Draft Plan of Subdivision for the site. It is scheduled to be voted on by City Council’s Planning Committee on September 29, 2026.
