The CN Rail appeal of a Hamilton Committee of Adjustment decision approving intensification within an existing building at 231 Bay Street North has been closed at the Ontario Land Tribunal.
CN Rail filed the appeal because the building’s long-standing residential use was not recognized and had not been deemed a “Class 4 Area” as defined by the “Environmental Noise Guideline — Stationary and Transportation Sources — Approval and Planning (NPC-300).”
In May, Hamilton City Council approved a motion to begin the process of applying the Class 4 Area designation to the property. That process remains ongoing.
Following council’s motion, the OLT appeal status was updated to closed.
Originally constructed in 1911, the three-storey brick building is most commonly known as the former Hamilton Bridge Company office. The building has an unobstructed line of sight, and a pathway for sound travel, to CN’s Stuart Yard on Hamilton’s west harbourfront.
The ownership, 231 BAY (HAMILTON) GP INC., is planning extensive renovations to convert the building into retail, restaurant, office, and personal service uses on the lower level, and 17 apartments on the Bay Street ground-level and upper floor.
The new units will be smaller than the units that currently exist. The present rental occupants delegated to Committee of Adjustment on February 12, 2026, and shared concerns about being renovicted and displaced.
231 BAY (HAMILTON) GP INC. has not yet reached the stage of approvals that trigger Hamilton’s renoviction protection bylaw. The renoviction protection provisions are triggered when a development applies for building permits. At that point, the landlord needs to prove removal of tenants is required to complete work, submit a tenant displacement plan that meets Hamilton’s requirements, and prove tenants will be able to return to their units after work is complete.
The City’s approvals at the Committee of Adjustment, and its agreement to designate the property as a Class 4 Area, are separate from the pending landlord-tenant matters.
