Ward 9 Hamilton City Councillor Brad Clark states he’s been informed that GFL has withdrawn its appeal of three administrative fines issued by Ontario’s Ministry of the Environment, Conservation and Parks.
The Ministry issued three fines, totalling $15,000, for three incidents in 2023 in which the Upper Stoney Creek landfill at 65 Green Mountain Road West violated provincial regulations by allowing odours to become a nuisance in the community.
GFL had appealed the $15,000 in fines to the Ontario Land Tribunal.
In June, Hamilton City Council voted unanimously to seek status as a municipality at the OLT to intervene against GFL and argue for dismissal of the appeal.
In an August 26 update, Clr Clark states the Ministry’s lawyers “have advised that there is no settlement and that GFL will be paying the fines.”
The Ministry has issued other charges regarding allowing odours to become a nuisance, exceeding standards for the emissions of total reduced sulphur compounds, allowing leachate to exceed legal limits, allowing waste to be dumped higher than the legal limit, and other offences.
