Hamilton’s Committee of Adjustment voted to end negotiations between City of Hamilton staff and the owner of 3392 Homestead Drive in Mount Hope, voting to deny a severance application at the property – despite both City staff and the landowner asking the committee to table the proposal because of ongoing talks.

The proposal is the latest intensification severance in Hamilton – the division of oversized single detached lots to permit the construction of a second single detached lot.

The Committee heard from a nearby resident who opposes intensification. The person cited neighbour character, including that most homes in the area are large.

“It would be between my home, which is almost 3500 square feet and the owner of this application’s home, which is 4500 square feet. This small, tiny home would look like a pool house or a garage sandwiched between two estate-like homes.”

The proposed severed lot sizes are 1118 square meters (12,000 sq feet) and 2517 square meters (27,100 square feet).

City staff wanted to discuss tree management and the setback requirements for the proposed second home.

CoA Member Laverne Gaddye instead moved denial.

“I visited this, and one of the previous speakers used the word shoehorn. And when I drove by it and looked at it, that’s exactly my thoughts,” he said.

“When I looked at it also, there’s three large trees in front of the place. One of those trees is going to have to come down if this lot is approved. So my recommendation is to not table it, to deny it and let that let them deal with it from there.”

The Committee unanimously denied the application.

The property owner can now appeal to the Ontario Land Tribunal.
