Is a nine storey residential development appropriate for the southeast corner of West 5th Street and Stone Church Road West?

This is the question which the Local Planning Appeal Tribunal will adjudicate during a seven day hearing scheduled to begin on October 18, 2021.

The developer, T. Valeri Construction, chose to bypass City Council and go directly to the LPAT on a non-decision appeal.

City Council, on a motion by Ward 8 City Councillor John Paul Danko, is opposing approval of the development. The site is located in Ward 8.

The application at 73, 77, 83, and 89 Stone Church Road West and 1029 West 5th Street is for a 9-storey 216 residential unit development with 221 parking spaces.

Lawyers for the City of Hamilton and developer will set a procedural order outlining how the seven days will be structured. The issues list will be contained within that order. The order will be released to the public by the Tribunal.

Each side plans to call two or three expert witnesses.

Nearby residents who registered to be participants have been instructed by the Tribunal to make written submissions.

Possibility of In-Person Hearing in Fall 2021

The Tribunal directed that the hearing will be conducted by video, and left open the possibility that the hearing may be conducted in-person if public health regulations allow in October 2021.

The LPAT, and all similar tribunals, are expected to issue directions for fall hearings at some point this summer.

Looks like a beautiful building…get it done..lookin to downsize…lived in neighbour hood 50 years and love it….get the project rolling……take example of burlington…they grow gorgeous condo projects like mushrooms…dont want to move there…love my. Chesley and stone church area..retiring in 3yrs…would be perfect timing to have this awesome lookin building to live in…with par k right behind…getter donešŸ‘šŸ‘
