Hamilton City Council has ceded all authority over public health matters since it unanimously created a fully independent Board of Health and successfully lobbied the Ontario government to amend the City of Hamilton Act.

“Council cannot override, amend or direct Board of Health decisions related to its statutory public health duties and equally important, public health decisions are not subject to Council approval,” writes City Solicitor Lisa Shields in a legal memo released Monday, June 1, 2026.

The legal boundaries became contentious last week when Hamilton’s Council entered closed session to discuss tensions between the Board of Health’s positions and viewpoints held by several Council members who do not sit on the Board.

Two councillors objected to the closed-door discussion: Nrinder Nann (Ward 3) and Brad Clark (Ward 9). Clark stated: “I can’t vote to go in-camera for this. This should be public. The legislation is public … It’s not something that should be discussed in-camera.”

The Board of Health comprises six Council members, six community representatives, and one education sector representative. Council appoints all members by majority vote for the duration of the sitting Council’s term.

The current Board’s composition, with a majority of members aligned with left and progressive-left political viewpoints, reflects the current City Council majority political alignment.

A point of sharp contention has emerged over supervised consumption sites. The Board has voted to urge the provincial government to reopen supervised consumption facilities and has sent letters on official City of Hamilton Public Health Services letterhead to provincial officials advocating for this position.

The City Solicitor’s memo appears as Item 6.1 on the June 3, 2026, City Council agenda. Council members are expected to publicly address the matter when it is considered.
