The status of the largest development proposal in Downtown Hamilton is unclear.
In mid-2024, IN8 Developments appealed to the Ontario Land Tribunal after the City of Hamilton declined to approve the fourth submission (third resubmission).
IN8 plans to build four tall buildings with a total of 2,181 units on the 3.55-acre site of the former Hamilton Eatons Centre site at 77 James Street North.
Talks between the City and IN8 reached an impasse, primarily because the City of Hamilton was unwilling to permit the phrasing of the development when calculating development charges.
A two-day Ontario Land Tribunal hearing to make the final decision on the development has been adjourned.
The City of Hamilton, in a written response to a question directed to the Acting Chief Planner, reads, “As this matter is currently before the Ontario Land Tribunal, the City is unable to comment.”
A request for comment was emailed to the lawyers for IN8 Developments. No response was received before publication.
