On September 10, 2024, Hamilton’s Committee of Adjustment chose to override the City’s source water and septic systems policies when approving an additional dwelling unit at 2016 Regional Road 56 in Glanbrook.
The property does not have the necessary size to build a large enough septic system to service an additional dwelling unit.
Potable water is transported to the property, which has a 2000-litre cistern.
During the September 10, 2024, Committee of Adjustment hearing, the applicant stated two families previously occupied the house. No documentation was provided to support the statement.
The applicant said they would conduct routine maintenance and emptying their existing septic tank.
City staff commented that the property is too small to build a backup septic tank if the present tank fails.
The Committee of Adjustment voted unanimously to approve the additional dwelling unit.
City staff have now filed an appeal to the Ontario Land Tribunal that requests the OLT uphold the City’s policies protecting groundwater.
Hamilton City Council will consider the appeal in the coming weeks. Council can vote in closed session to withdraw the appeal.
