The Ontario Land Tribunal is moving quickly to hear a non-decision appeal at 1065 Paramount Drive in Upper Stoney Creek.

A nine-day contested hearing will begin on October 1, 2024.

Mikmada Homes seeks to build an eight-storey condo building and a block of stacked townhouses. There will be 304 dwelling units and 415 vehicle parking spaces.

A series of official plan and zoning bylaw amendments are required for the development, which will be zoned “High Density Residential 1.”

The City of Hamilton’s professional planning staff indicated to the developer they would not support the proposal.

Upon learning this, Mikmada Homes appealed to the OLT before City Council could decide on the proposal. A non-decision appeal is more favourable for the developer.

Issues List

City staff state they cannot support the proposal due to the following reasons:

  • Not enough mix of unit sizes, with no family (three-bedroom) units proposed;
  • Lack of landscaping and sustainable design features;
  • Shadow impacts upon the neighbouring elementary school;
  • Design of the buildings does not fit into the existing neighbourhood;
    • “The Albion neighbourhood has historically developed with a more suburban built form with greater building setbacks for the multiple dwellings that exist, for example at the corner of Mistywood Drive and Paramount Drive. The proposal is instead for a built form that is oriented closer to the street and the edges of the property with reduced building setbacks.”

Nine Nearby Residents Permitted Written Statements

Nine individuals were granted participant status for the hearing, and have until Friday, August 16, 2024, to send their written submissions to the Tribunal.
