Hamilton Committee of Adjustment Vice-Chair Dale Smith declared a conflict of interest on a matter in front of the committee on Thursday, stating he has an interest in an application at 0 Chippewa Road in Glanbrook.
The nature of the interest was not shared. It was not stated if this involves a pecuniary interest or a matter of potential private gain.
Smith is registered to speak to the committee to put forth his views on the matter.
The application was tabled, and Smith did not speak Thursday. His views are not publicly known.
I could find no case law in which a member of a local board presented themselves as a delegate on a matter in which they have an interest.
The Municipal Conflict of Interest Act states that a member of a local board “shall not attempt in any way whether before, during or after the meeting to influence the voting on any such question” that they have declared a conflict upon.
I’ll be watching this case as it develops.
