Hamilton’s Committee of Adjustment is scheduled to meet on Thursday, September 4, 2025 to hear 32 matters. The meeting begins at 1:00 p.m. and will be livestreamed on YouTube.

Renoviction Variances: 103 Emerald Street South
The owner of 103 Emerald Street South wants to evict all tenants, including many who have lived in the building for over 40 years, and in some cases, 50 years.
The corporation has been unsuccessful, thus far.
In March, the Ontario Landlord and Tenant Board denied an eviction application because the owner did not yet have municipal approvals needed to begin the renovictions.
The application, to add five units to the basement of the five-storey apartment building, will be considered by Hamilton’s Committee of Adjustment.
If approved, the building corporation will be able to return to the Landlord and Tenant Board to argue it needs to remove all tenants to complete the work of adding the five units.
Because the proposal conforms to both provincial planning and building code requirements, the City of Hamilton’s staff must recommend approval.
If the Committee approves the variances, the tenants could face eviction by the end of the year.
If the Committee denies the variances, the ownership will have to appeal the decision to the Ontario Land Tribunal.
An OLT appeal will delay the ownership from filing new eviction notices until such time as the OLT renders a decision.
This hearing is scheduled for 1:35 p.m.
Noted: Severances on Delawana Drive
Dicenzo Management Inc. is severing the lots of its rental semi-detached duplexes on Delawana Drive in East Hamilton’s Riverdale neighbourhood.
The ownership does not need to explain why it is seeking the severances; the approval is as close to as-of-right as severances can be.
Usually, these kinds of severances are done in advance of selling properties.
The Dicenzo company is planning new high-rise projects, and most large rental companies are moving out of low-rise rental homes in favour of higher-density, purpose-built apartments.
Noteworthy Housekeeping Items
95 Dundurn Street South: The Committee of Adjustment is expected to approve setback, canopy, and parking variances to permit Sacajawea Non-Profit Housing to construct a five-storey, 15-unit apartment building.
738 Upper Gage Avenue: The owner is seeking permission to build a detached additional dwelling unit. The ADU, as proposed, is larger than permitted and does not have a proper walkway design. City staff is recommending the tabling of the application, and that the owner make revisions. Owners usually accept tabling, meet with staff, make revisions, and return to the committee at a later date for approval.
