The City of Hamilton and IN8 Developments have not provided the Ontario Land Tribunal an update on the status of settlement talks as they committed to do by February 28.

The two sides were scheduled to appear before the Tribunal for a two-day contested hearing at the end of January.

IN8 filed the OLT appeal after the City of Hamilton declined to approve the final Site Plan application for the redevelopment of 77 James Street North, the former Hamilton City Centre.

Four tall buildings, consisting of 2,181 residential units and ground floor commercial, are planned for the 3.55-acre downtown Hamilton property.

IN8 wants to pay full project development charges (DCs) when construction begins. The City of Hamilton wants to phase DCs for each of the proposed four towers – enabling the City to collect future higher DCs when each tower begins to rise above the foundation.

The January hearing was adjourned at the parties’ request. They told the OLT were engaged in settlement discussions and would update the Tribunal no later than February 28.

As of March 10, the parties have not provided an update to the OLT.
