Core Development Group Ltd. is seeking six minor variances from Hamilton’s Committee of Adjustment (CoA) to facilitate their Site Plan application to build a 30-storey mixed-use condominium building.

The City granted Conditional Approval on December 22, 2023.

The conditions include applying for a Zoning By-law Amendment to remove holding conditions requirements for studies and confirmation of maximum height.

Four of the variances are for reduced setbacks, one is to permit 70 centimetres of additional height than permitted in the Downtown Secondary Plan, and the final request is to reduce parking to 170 vehicle spots from the requirement for 180 parking spots. [The 170 spots would be permitted as-of-right under Hamilton’s new parking bylaw. The Bylaw is under appeal at the Ontario Land Tribunal.]

Hamilton’s Design Review Panel considered the proposal in July 2023.

The plan before the CoA also contains 380 units: 205 one-bedroom, 55 one-bedroom plus den, 104 two-bedroom, and 16 two-bedroom plus den units.

The July 2023 design review submission stated the building was planned to be 31-storeys. At the time, the rooftop included an outdoor amenity. The latest version retains the rooftop mechanical penthouse without amenities. Therefore, the building is now considered to be 30-storeys.

The Committee of Adjustment hearing is scheduled for 1:45 p.m. on October 8 at City Hall.

In late 2023, the developer filed a formal consultation application for 41-storeys with 500 residential units and a “podium between 7 and 13 stories.”  No official Planning Act application has been made for this higher proposal.
