The Ontario Land Tribunal approved a severance for 28 Oakley Court in Ancaster during a half-day appeal hearing this morning.
The owner of the property applied to Hamilton’s Committee of Adjustment to divide the approximately 19-metre-by-30.5-metre property into three lots, with a plan to build three street townhouses in place of the existing single detached home on the property.
The severance application was supported by the City’s planning staff, who confirmed it complied with the Provincial Policy Statement, and the Urban Hamilton Official Plan’s intensification requirements.
During an August meeting, the Committee of Adjustment decided to deny the application, with some members arguing that Ancaster is a special community, and provincial planning policies should not be applied in established neighbourhoods.
Following the denial, the owner, Nathan Skeba, appealed the decision to the OLT.
In today’s hearing, OLT Member Steven Mastoras explained the process for numerous community members, and directed the owner’s professional planner Scott Beedie to explain how they were responding to community concerns contained within written participant statements.
The City of Hamilton did not oppose the appeal. There were no City lawyers or staff in today’s video hearing.
Observers heard that concerns regarding tree protection planning, traffic, stormwater management, and other issues will be resolved during future City planning and permit processes.
OLT Member Mastoras emphasised that today’s hearing only pertained to the property severances and that if variances are required for the new street townhouses, the application would have to be decided by the Committee of Adjustment.
The owner’s lawyer confirmed they will comply with conditions requested by the City of Hamilton.
Mastoras issued an oral approval decision at the end of today’s hearing. A written OLT decision will be issued at a later date.
