There will be an Agreed Statement of Facts filed to the Ontario Land Tribunal in advance of the February 18, 2025, scheduled start of the contested hearing of CN’s appeal of the Jamesville redevelopment plan.
The Ontario Land Tribunal states there parties are working on the statement.
The status of settlement talks is not publicly known.
The City of Hamilton (and its subsidiary housing provider CityHousing Hamilton, City’s approved developer Jamesville Development LP, and CN continue to meet.
Recent Updates
Earlier today, November 26, the CityHousing Hamilton Board discussed the OLT appeal in a closed session meeting. No public updates were issued.
Experts for all parties met on October 18. There have been other undisclosed settlement negotiation meetings.
On October 16, City Council met in closed session and approved confidential instructions to its negotiators.
Background
CN appealed against last term’s City Council approval for a mixed market and social housing redevelopment of the site at 405 James Street North, a property close to the main CN line through Hamilton.
CN is concerned about the development’s proximity to CN operations that generate dust and noise impacts.
The City, CN, and the City’s approved developer Jamesville Development LP, have been meeting for the past two years in the hope of reaching a settlement.
Experts for all parties are scheduled to meet this Friday to create an agreed statement of facts and opinions to provide to the Ontario Land Tribunal.
The OLT is assisting the parties with mediation.
A contested OLT hearing is scheduled for February 18, 2025.
Hamilton Mayor Andrea Horwath brought Ontario Minister of Municipal Affairs and Housing Paul Calandra to the Jamesville site this past summer. Mayor Horwath stated she sought the Minister’s assistance in the matter.
