Hamilton City Council and New Horizon Development Group (NHDG) have reached a settlement for the redevelopment of the formal Delta Secondary School property at 1284 Main Street East.

The details of the deal have not yet been released to the public.

Lawyers for the City and NHDG appeared before the Ontario Land Tribunal today. Both sides stated they are working to implement the settlement agreement and asked the Tribunal to schedule an approval hearing for the end of October.

“We had anticipated using today for a settlement hearing,” NHDG’s lawyer David Bronskill told the Tribunal, “Without divulging the details of that implementation, I would say it is going very, very well.”

“There are some details that we need to work out. Unfortunately, we weren’t able to finalize all of those details with sufficient opportunity to have today be a settlement hearing”

City lawyer Patrick MacDonald confirmed settlement implementation is close to completion.

Today’s eight-minute hearing ended with October 22, 2024, being set as the date for the settlement hearing.

NDHG and the City must file settlement materials to the Tribunal no later than October 16.

City Council’s Planning Committee approved the settlement on July 9.

NHDG filed their non-decision appeal in August 2023, after receiving critical feedback from the City and Hamilton’s Design Review Panel regarding the level of intensification within the site design.
